These terms govern access to and use of the Treat.Me website, mobile application, event tools, payment flows, merchant coordination tools, communications, and related services.

These User Terms and Conditions (the “Terms”) are a legally binding agreement between you and Treat.Me (“Treat.Me,” “we,” “us,” or “our”) governing your access to and use of the Treat.Me mobile application, website, services, features, communications, payment flows, event tools, merchant coordination tools, and related services (collectively, the “Service”).

Please read these Terms carefully. By creating an account, accessing the Service, creating or joining an event, placing or participating in an order, making or receiving any payment-related benefit, or otherwise using Treat.Me, you agree to these Terms, our Privacy Policy, our User Guidelines and Safety Tips, and any additional policies referenced in these Terms.

If you do not agree to these Terms, you must not access or use Treat.Me.

1. Overview of Treat.Me

Treat.Me is a location-based social dining and merchant coordination platform. The Service allows eligible users to create, discover, join, and participate in food-centered events at participating merchants.

Treat.Me is not a restaurant, food preparation service, delivery service, payment card issuer, bank, dating service, background-check provider, emergency service, transportation provider, or law enforcement agency. Treat.Me provides technology that helps users coordinate events with each other and with participating merchants.

2. Important Notices

2.1 Binding Agreement

These Terms form a binding agreement between you and Treat.Me. You are responsible for reading and understanding these Terms before using the Service.

2.2 Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction if higher, to use Treat.Me.

2.3 Real-World Meetups

Treat.Me events may involve in-person meetings at merchant locations. You are responsible for using reasonable judgment, following safety guidance, and complying with all applicable laws during online and offline interactions.

2.4 Payments, Fees, and Cancellation Outcomes

Treat.Me events may involve payments, service fees, authorization holds, payment captures, refunds, retained fees, cancellation fees, or other settlement adjustments. The final outcome may depend on the event status, the stage of the event, the reason the event ended, the party responsible for the cancellation or failure, merchant participation, and applicable law.

2.5 No Emergency Monitoring

Treat.Me does not monitor all events in real time and is not an emergency response service. If you believe you are in danger or require urgent assistance, contact local emergency services immediately.

3. Definitions

For purposes of these Terms:

3.1 “Account”

An account created by a user to access and use Treat.Me.

3.2 “Bid”

An expression of interest in an event. Depending on the event type, a bid may indicate interest, acceptance, or claim of an invitation.

3.3 “Event”

A planned Treat.Me interaction involving one or more users and a participating merchant. An event may include a selected place, order details, participant matching, merchant acceptance, travel to the merchant, verification, fulfillment, and completion.

3.4 “Guest”

The user who receives the benefit of the host’s payment or sponsorship.

3.5 “Host”

The user responsible for paying for the event or order. The host is the payer for the event unless Treat.Me expressly indicates otherwise.

3.6 “Initiator”

The user who creates an event. In a conventional host-created event, the initiator is typically the host. In a Treat.Me-style event where a guest seeks a host, the initiator may be the guest.

3.7 “Participant”

The user who joins, accepts, claims, or is selected for an event.

3.8 “Merchant”

A restaurant, venue, or establishment participating in Treat.Me and responsible for fulfilling approved orders.

3.9 “Order”

The food, beverage, item, service, reservation-related selection, merchant instruction, or other merchant fulfillment request associated with an event.

3.10 “Place”

The merchant location or venue selected for an event.

3.11 “Service Fee”

A fee charged by Treat.Me to support operation of the platform, payment coordination, user and merchant tools, safety workflows, support, and related services.

3.12 “Cancellation Fee”

A fee that may apply when an event ends before completion due to cancellation, no-show, verification failure, safety interruption, merchant cancellation, system cancellation, expiration, or another termination reason.

3.13 “Settlement”

The final calculation of amounts paid, refunded, retained, credited, transferred, or charged after an event is completed, cancelled, expired, disputed, or otherwise terminated.

3.14 “User,” “You,” or “Your”

Any person who accesses or uses Treat.Me, including hosts, guests, initiators, participants, and account holders.

4. Account Registration and Security

4.1 Account Creation

To use certain features, you must create an account and provide accurate, current, and complete information. You agree to keep your information updated.

4.2 Identity and Profile Accuracy

You may not impersonate another person, misrepresent your identity, create a misleading profile, use another person’s photos without permission, or provide false information to Treat.Me, other users, merchants, or payment processors.

4.3 One Account Per User

Unless Treat.Me gives written permission, you may not maintain multiple accounts, create replacement accounts after suspension, or help another person evade enforcement action.

4.4 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring through your account. You must notify Treat.Me promptly if you suspect unauthorized access.

4.5 Device Sessions

Treat.Me may allow you to access your account from more than one device. You are responsible for devices logged into your account. Treat.Me may revoke sessions, require reauthentication, or restrict access if suspicious activity is detected.

4.6 Account Review

Treat.Me may review accounts, profile content, event activity, payment activity, reports, device signals, location-related signals, merchant reports, and other available information to detect misuse, enforce these Terms, protect users, or comply with legal obligations.

5. Eligibility and User Responsibilities

5.1 Age Requirement

You must be at least eighteen (18) years old or the age of majority in your jurisdiction, whichever is higher.

5.3 Compliance with Law

You agree to comply with all laws, regulations, rules, merchant policies, venue rules, payment network rules, and safety requirements applicable to your use of Treat.Me.

5.4 Personal Use

Treat.Me is intended for personal use unless we authorize otherwise. You may not use the Service for unauthorized commercial solicitation, lead generation, resale, scraping, fraud, or platform manipulation.

5.5 Responsibility for Offline Conduct

You are responsible for your conduct before, during, and after Treat.Me events. Treat.Me is not responsible for the acts, omissions, statements, conduct, food handling, service quality, or safety practices of users or merchants, except to the extent required by law.

6. Event Types and Participation

6.1 Event Types

Treat.Me may support different event types, including:

  • Open Events: Events made visible to eligible users in the applicable area or event board.
  • Closed Events: Events sent directly to a selected user or shared by invitation.
  • Treat.Me Events: Events where a guest may initiate an event seeking a host.

Treat.Me may add, remove, modify, rename, or limit event types at any time.

6.2 Bids, Acceptances, and Matching

Submitting a bid, accepting an event, claiming an invitation, or being selected for an event may create obligations under these Terms, including attendance, timely communication, verification, payment, cancellation, and settlement obligations.

6.3 No Guaranteed Match

Treat.Me does not guarantee that any event will receive bids, be accepted, be approved by a merchant, result in a successful meetup, or be completed.

6.4 Event Constraints

An event may include limits, budgets, selected items, merchant availability, eligibility rules, location requirements, timing requirements, or other constraints. You agree to comply with any constraints shown in the Service.

6.5 Merchant Approval

An event or order may require merchant acceptance before it proceeds. A merchant may decline, cancel, reject, modify, delay, or be unable to fulfill an order. Treat.Me is not responsible for merchant availability, menu accuracy, preparation times, service quality, item substitution, or merchant conduct, except to the extent required by law.

7. Host and Guest Roles

7.1 Host Responsibilities

A host is responsible for:

  • Providing and maintaining a valid payment method.
  • Paying applicable order amounts, taxes, tips if supported, service fees, cancellation fees, dispute amounts, or other charges shown or authorized through the Service.
  • Attending the event if required.
  • Cooperating with verification and merchant handoff requirements.
  • Avoiding conduct that causes unnecessary cancellation, delay, failed verification, no-show, or merchant disruption.

7.2 Guest Responsibilities

A guest is responsible for:

  • Accurately representing their availability and intent to attend.
  • Complying with event constraints and merchant rules.
  • Attending the event if accepted or matched.
  • Cooperating with verification and merchant handoff requirements.
  • Avoiding conduct that causes unnecessary cancellation, delay, failed verification, no-show, or merchant disruption.

7.3 Initiator and Participant Roles

Certain obligations depend on whether a user is the initiator or participant, rather than whether the user is the host or guest. Treat.Me may determine responsibility based on event type, user action, event stage, verification status, location status, merchant status, and available platform records.

7.4 Host Always Pays Unless Otherwise Stated

Unless Treat.Me expressly states otherwise in the Service, the host is the payer for the event. A guest may still be responsible for cancellation fees, no-show fees, dispute amounts, misuse, damage, chargeback losses, or other amounts caused by the guest’s conduct where permitted by law and disclosed through the Service.

8. Merchant Relationship

8.1 Merchants Are Independent

Merchants are independent businesses and are not employees, agents, partners, or representatives of Treat.Me.

8.2 Merchant Terms and Venue Rules

You must comply with merchant policies, venue rules, dress codes, reservation rules, age restrictions, alcohol rules, safety requirements, and staff instructions.

8.3 Menu and Availability

Menu items, prices, availability, preparation times, taxes, substitutions, fees, hours, and merchant participation may change. Treat.Me may display merchant information supplied by merchants or third parties, but does not guarantee that all information will be accurate, complete, or current.

8.4 Alcohol, Age-Restricted Items, and Restricted Goods

Treat.Me may restrict or prohibit certain items, including alcohol, age-restricted goods, tobacco, controlled substances, illegal goods, or other restricted items. You are responsible for complying with all laws and merchant requirements relating to age-restricted items.

8.5 Merchant Verification

A merchant may be required to verify the host, event, order, code, QR process, or other confirmation details before fulfilling an order. Failure to complete merchant verification may result in cancellation, refund adjustment, retained fees, cancellation fees, denial of fulfillment, account review, or other enforcement action.

9. Location, ETA, Attendance, and Verification

9.1 Location Use

Treat.Me may use approximate or event-related location information to help display nearby merchants or events, coordinate meetups, support ETA and no-show workflows, support safety features, verify attendance, prevent misuse, and resolve disputes.

9.2 Meetup Time and Timing

Events coordinate around a single agreed meetup time shown to all committed parties — either a time selected when the event was created, or a time fixed when the merchant accepts a "meet now" event. During an event, Treat.Me may require users to confirm attendance, travel to the merchant, or remain within a reasonable proximity of the merchant. Travel estimates users provide are informational; lateness, no-shows, cancellation outcomes, and settlement outcomes are determined against the agreed meetup time and the verification steps described below. Location signals may be used to confirm a user's presence; absence of a location signal is not, by itself, treated as absence from the meetup.

9.3 Late Arrival

A user may be treated as late if the user has not arrived by the agreed meetup time, subject to the proximity and grace requirements shown in the Service or determined by Treat.Me's operational rules.

9.4 No-Show

A user may be treated as a no-show if the user fails to arrive, fails to verify attendance, fails to remain reachable, fails to proceed with required event steps, or otherwise does not participate within the applicable time and proximity requirements.

9.5 Mutual Verification

Treat.Me may require users to verify each other before proceeding to merchant fulfillment. Verification may involve QR code scanning, device authentication, code entry, location proximity, user confirmation, or other steps.

9.6 Failed Verification

A failed, skipped, expired, manipulated, or disputed verification may result in cancellation, refund adjustment, retained fees, cancellation fees, denial of fulfillment, account review, or enforcement action. Treat.Me may determine responsibility based on available records.

9.7 Merchant Verification

After mutual verification, the merchant may be required to verify the host, event, order, or code before fulfillment. A failure or expiration at this stage may affect completion, settlement, fees, refunds, account status, and dispute review.

9.8 Verification Does Not Guarantee Safety

Verification helps support event coordination, accountability, and order handoff. It does not guarantee personal safety, identity accuracy, user intent, merchant performance, or successful completion.

10. Payments, Authorization, Charges, and Fees

10.1 Payment Processor

Treat.Me uses third-party payment processors, including Stripe, to process payments, payment methods, authorizations, captures, refunds, transfers, application fees, and related payment services. By using payment features, you agree to comply with applicable payment processor terms and requirements.

10.2 Payment Method Authorization

You authorize Treat.Me and its payment processors to charge, authorize, capture, reverse, refund, retain, transfer, or settle amounts associated with your use of the Service, including order amounts, taxes, merchant charges, service fees, cancellation fees, no-show fees, dispute amounts, chargeback amounts, and other amounts disclosed through the Service or permitted by these Terms.

10.3 Host Payment Responsibility

The host authorizes payment for the event, including applicable merchant charges, taxes, service fees, and any other amounts shown or authorized through the Service. The host may be charged when the event reaches the applicable payment stage, which may include merchant acceptance, order confirmation, fulfillment, completion, or another stage shown in the Service.

10.4 Guest Payment Responsibility

A guest may be required to maintain a valid payment method for cancellation fees, no-show fees, misuse, disputes, or other obligations disclosed through the Service. Guest payment responsibility does not make the guest the host unless Treat.Me expressly states otherwise.

10.5 Service Fees

Treat.Me may charge service fees to users, merchants, or both. Service fees may support platform operation, payment coordination, fraud prevention, safety workflows, support, infrastructure, and administrative costs. Service fees may be non-refundable depending on the event stage, cancellation reason, responsible party, and applicable policy.

10.6 Taxes

Tax amounts shown at checkout are estimates, calculated at order time from merchant information, local tax rules, and order details. The tax amount authorized for an order is final for that order: Treat.Me does not adjust it after the order is placed to reflect a merchant's own tax accounting, in either direction. Where an order or its subtotal is refunded, applicable taxes are handled as described in Section 11.24.

10.7 Payment Holds and Captures

Treat.Me may place an authorization hold before final charge capture. Authorization holds are not final charges, but they may affect the available balance on your payment method. Your bank or card issuer controls how long released holds remain visible.

10.8 Refunds

Refunds may be full, partial, delayed, denied, offset against fees, or processed through the original payment method depending on event status, cancellation stage, responsible party, merchant status, payment processor rules, and applicable law.

10.9 Failed Payments

If a payment, authorization, capture, refund reversal, fee collection, or settlement adjustment fails, Treat.Me may retry the payment, request a new payment method, restrict account features, cancel events, suspend the account, or take other lawful steps to collect amounts owed.

10.10 Chargebacks and Payment Disputes

You agree not to initiate improper chargebacks or payment disputes for amounts you authorized or for services provided in accordance with these Terms. If you believe a charge is incorrect, contact Treat.Me support first. Treat.Me may contest chargebacks, provide records to payment processors, suspend accounts, or recover chargeback-related losses where permitted by law.

10.11 No Off-Platform Payment Circumvention

You may not use Treat.Me to arrange an event and then complete payment, compensation, refund, reimbursement, or order fulfillment outside the Service in a way that avoids Treat.Me fees, payment protections, merchant workflows, or safety controls.

11. Cancellation, Expiration, No-Show, and Refund Policy

This Section explains how Treat.Me handles events that do not complete. It is intended to be user-facing and does not include internal technical rules, formulas, or dollar values.

11.1 General Principles

Treat.Me’s cancellation policy is designed to:

  • Encourage users to cancel early when they cannot attend.
  • Reduce inconvenience to matched users and merchants.
  • Protect merchants from late-stage disruption.
  • Protect hosts from paying for events that do not proceed where the host is not at fault.
  • Treat no-shows, failed verification, and late-stage cancellations more seriously than early cancellations.
  • Apply outcomes based on the reason the event ended, the event stage, the responsible party, and available platform records.

11.2 No Dollar Values in These Terms

The Service may display specific amounts, estimates, line items, or fee labels during cancellation, checkout, refund, or settlement flows. These Terms describe when fees may apply but do not state fixed dollar amounts. Any displayed amount may depend on the event, merchant, order, fees, taxes, stage, payment processor rules, and applicable policy.

11.3 Cancellation Before a Match

If an event is cancelled before a participant is accepted or matched, cancellation fees generally do not apply. Any payment authorization may be released or refunded, subject to payment processor timing and applicable law.

11.4 Cancellation After Interest or Bids But Before Match

If an event has received interest or bids but no participant has been accepted or matched, cancellation fees generally do not apply. Treat.Me may still restrict misuse, spam, repeated cancellations, or behavior that disrupts the Service.

11.5 Cancellation After Match But Before Merchant Submission

If an event is cancelled after a participant is accepted or matched but before the order is submitted to the merchant, cancellation fees generally do not apply, unless Treat.Me determines that fraud, abuse, repeated misuse, intentional disruption, or another policy violation occurred.

11.6 Cancellation While Merchant Response Is Pending

If the order has been submitted to a merchant and the merchant has not yet accepted or declined, cancellation fees may not apply in ordinary cases. However, Treat.Me may retain or charge applicable service fees if disclosed in the cancellation flow or if the cancellation is part of misuse, manipulation, or repeated disruption.

11.7 Merchant Declines the Order

If the merchant declines the order before accepting it, the event may end without cancellation fees to the users in ordinary cases. Payment authorizations may be released or refunded, subject to payment processor timing and applicable law.

11.8 Merchant Does Not Respond

If the merchant fails to respond within the required time, the event may expire. In ordinary cases, users are not charged cancellation fees for merchant non-response. Treat.Me may release or refund applicable amounts, subject to payment processor timing and applicable law.

11.9 Cancellation After Merchant Acceptance

Once a merchant accepts an event or order, the cancellation policy becomes stricter because the merchant, host, guest, and platform may have already committed resources. If a user cancels after merchant acceptance, Treat.Me may:

  • Refund the order subtotal and taxes where appropriate.
  • Retain one or more service fees.
  • Charge or retain a cancellation fee.
  • Credit or compensate a merchant where appropriate.
  • Adjust amounts based on the responsible party.
  • Restrict repeated late-stage cancellations.

11.10 Cancellation After Transaction Start or Meetup Start

If an event has formally started, ETA tracking has begun, users are en route, or the meetup window has opened, cancellation may result in retained service fees and cancellation fees. Treat.Me may consider user location, ETA, communication, verification status, merchant status, safety reports, and other available records.

11.11 Late Arrival

If a user is late beyond the applicable threshold, Treat.Me may warn the user, allow additional time, permit cancellation, assess responsibility, or apply cancellation outcomes. Late arrival may become a no-show if the user does not arrive within the applicable grace period.

11.12 No-Show

If a user is determined to be a no-show, Treat.Me may impose no-show fees, retain service fees, deny refunds, issue partial refunds, compensate affected parties, restrict account features, or suspend the account. A no-show may be determined based on ETA, proximity, verification, communication, merchant records, or other available information.

11.13 Cancellation During Mutual Verification

If an event is cancelled while mutual verification is pending or in progress, Treat.Me may determine responsibility based on the party who cancelled, the verification status, location records, user reports, and other available evidence. Cancellation fees or retained service fees may apply.

11.14 Failed Mutual Verification

If mutual verification fails, expires, is refused, is manipulated, or cannot be completed, Treat.Me may cancel the event and determine responsibility. Depending on the circumstances, Treat.Me may refund some amounts, retain service fees, apply cancellation fees, restrict future events, or require additional account review.

11.15 Cancellation After Mutual Verification

After mutual verification succeeds or is validly completed, the policy is stricter because the users have met and the event has progressed closer to merchant fulfillment. Cancellation at this stage may result in retained service fees, cancellation fees, partial refunds, denied refunds, or other settlement adjustments.

11.16 Cancellation During Merchant Verification

If a cancellation occurs while merchant verification is pending or in progress, Treat.Me may consider whether the host, guest, merchant, or system caused the failure. Cancellation fees or retained service fees may apply depending on responsibility and event status.

11.17 Failed Merchant Verification

If merchant verification fails, expires, is refused, or cannot be completed, Treat.Me may cancel the event and determine responsibility based on available records. Outcomes may include refund, partial refund, retained service fees, cancellation fees, account review, or merchant review.

11.18 Cancellation After Merchant Verification or During Fulfillment

Once merchant verification succeeds, the order is final. After this point, cancellation is no longer available to you or to the merchant, and the event proceeds to fulfillment and completion. The merchant has verified your order and payment has been captured; the only remaining outcome is completion. If a genuine problem occurs after verification (for example, the merchant cannot provide the prepared items), contact Treat.Me support, which may review the event and apply an appropriate adjustment.

11.19 Merchant Cancellation After Acceptance

If a merchant cancels after accepting an order, users are not charged cancellation fees, and Treat.Me will generally refund the order subtotal and applicable taxes in full and release or refund the customer-facing service fee, subject to payment processor timing and applicable law, unless the cancellation resulted from user misconduct.

Merchants are accountable for cancellations they cause. The merchant states a reason when cancelling, and Treat.Me classifies the cancellation using available records (for example, whether the venue was genuinely disrupted, whether users were already present, and how close the cancellation was to the agreed meetup time). A merchant found responsible may be charged merchant-side fees, and merchants who repeatedly cancel may receive warnings, be placed under review, or be temporarily suspended from receiving new orders. Treat.Me does not currently provide additional compensation or credits beyond the refunds described above.

11.20 System Cancellation

Treat.Me may cancel an event due to system error, safety concern, payment failure, suspected fraud, unavailable merchant, policy violation, expired timing window, technical failure, legal issue, or other operational reason. If Treat.Me cancels an event for reasons not caused by user misconduct, users generally will not be charged cancellation fees.

11.21 Safety Reports During an Active Event

If a user submits a safety report during an active event, Treat.Me may pause, cancel, or review the event. Treat.Me may determine settlement after reviewing available information. A safety report made in bad faith may result in fees, account restrictions, or suspension.

11.22 Responsible Party

Treat.Me may determine a responsible party for cancellation or failure. Responsibility may be assigned to the initiator, participant, host, guest, merchant, system, or no party. Responsibility is not always the same as payment liability. Treat.Me may assign financial consequences based on the specific circumstances and applicable policy.

11.23 Service Fee Retention

Treat.Me may retain customer-facing or merchant-facing service fees depending on the event stage, cancellation reason, responsible party, merchant status, and disclosed policy. Service fees may be retained even where the order subtotal or tax is refunded.

11.24 Subtotal and Tax Refunds

When Treat.Me refunds an order subtotal, applicable tax refunds may be processed together with the subtotal where required or supported. Tax treatment may depend on payment processor rules, merchant tax treatment, local law, and whether the transaction was completed, reversed, refunded, or partially refunded.

11.25 Cancellation Fees

Cancellation fees may apply when an event is cancelled or fails after the parties or merchant have committed time, inventory, preparation, travel, verification, or fulfillment effort. Cancellation fees may vary by stage and may be more likely after merchant acceptance, during the meetup window, immediately before the meetup, or after a no-show. (After merchant verification succeeds, cancellation is no longer available — see Section 11.18.)

11.26 Place-Specific Policies

Some merchants or locations may have specific cancellation or refund requirements. Where a place-specific policy applies and is disclosed or otherwise applicable, that policy may control over the default Treat.Me policy for that event.

11.27 Prepare and Confirm Flow

Treat.Me may show a cancellation review screen before final cancellation. The review screen may include estimated refunds, retained fees, cancellation fees, responsible party information, or confirmation requirements. A cancellation may not be final until you complete the required confirmation step.

11.28 Estimates and Final Amounts

Cancellation screens may show estimated amounts. Final amounts may differ due to tax adjustments, payment processor timing, merchant status, currency rounding, payment method rules, chargeback activity, dispute resolution, or final settlement review.

11.29 Refund Timing

Refund timing depends on the payment processor, card network, bank, payment method, merchant account, and applicable law. Treat.Me does not control how long a bank or card issuer takes to post released holds or refunds.

11.30 Emergencies and Exceptional Circumstances

Treat.Me may waive, reduce, reverse, or modify cancellation outcomes in exceptional circumstances, including verified emergencies, severe weather, safety concerns, merchant closure, platform error, or other events beyond a user’s reasonable control. Treat.Me may request supporting information.

11.31 Abuse of Cancellation Rights

Treat.Me may restrict, suspend, or terminate accounts that repeatedly cancel, no-show, manipulate verification, file false reports, misuse refunds, abuse payment disputes, or otherwise disrupt events.

11.32 Final Review Authority

Treat.Me may review cancellation outcomes and correct errors. Treat.Me’s decision regarding refunds, retained fees, cancellation fees, no-shows, verification failure, and responsibility will be based on available information and will be final to the fullest extent permitted by law.

12. Refunds, Credits, and Adjustments

12.1 Form of Refund

Refunds are generally issued to the original payment method, unless Treat.Me determines another method is appropriate or required by law.

12.2 Credits

Treat.Me may offer account credits, promotional credits, goodwill credits, merchant credits, or other adjustments. Credits are not cash, may expire, may be non-transferable, and may be subject to additional terms.

12.3 Partial Refunds

Treat.Me may issue partial refunds if only part of an order, fee, tax, service, or event is eligible for refund.

12.4 Reversals and Corrections

Treat.Me may reverse, correct, reduce, or recover refunds or credits issued in error, obtained through misuse, or later determined to be unsupported by the event record.

12.5 No Guaranteed Refund for Completed Events

Once an event is completed or fulfillment has occurred, refunds are not guaranteed. Any refund may depend on merchant policy, payment processor rules, Treat.Me review, safety issues, service failure, legal requirements, and available evidence.

13. User Conduct

13.1 Respectful Conduct

You agree to treat users, merchants, staff, and Treat.Me personnel with respect. Harassment, intimidation, threats, stalking, hate speech, bullying, abusive language, discrimination, exploitation, or unsafe conduct is prohibited.

13.2 In-Person Conduct

During Treat.Me events, you must behave lawfully and respectfully, follow merchant rules, avoid disruptive conduct, and leave immediately if asked by merchant staff, Treat.Me, or law enforcement.

13.3 Communications

You may not send spam, scams, threats, explicit content, abusive content, unlawful content, commercial solicitation, misleading information, or content that violates another person’s rights.

13.4 No Side Deals

You may not pressure another user or merchant to bypass Treat.Me, change payment outside the Service, accept reimbursement outside the Service, share private payment information, or complete a Treat.Me event off-platform.

13.5 No Misuse of Safety Features

You may not knowingly submit false reports, misuse emergency or support workflows, manipulate verification, spoof location, interfere with event records, or use safety tools to harass, threaten, or gain unfair advantage.

14. Prohibited Activities

You may not:

  • Violate any applicable law or regulation.
  • Use Treat.Me for fraud, theft, scams, money laundering, chargeback abuse, or payment manipulation.
  • Impersonate another person or misrepresent your identity, age, affiliation, availability, or intent.
  • Create fake accounts, duplicate accounts, or accounts for another person without authorization.
  • Harass, threaten, stalk, exploit, discriminate against, or harm another person.
  • Post or transmit unlawful, explicit, violent, hateful, abusive, defamatory, invasive, or misleading content.
  • Solicit money, gifts, loans, investments, donations, financial information, or payment information from users outside official Treat.Me processes.
  • Use bots, scrapers, crawlers, automated tools, or unauthorized scripts.
  • Reverse engineer, copy, modify, disrupt, overload, or interfere with the Service.
  • Circumvent access controls, security features, verification systems, payment flows, rate limits, or account restrictions.
  • Submit false safety reports, false refund claims, false chargebacks, or false merchant complaints.
  • Use Treat.Me to promote illegal goods, restricted goods, adult services, controlled substances, weapons, gambling, or other prohibited activities.
  • Interfere with merchant operations or staff.
  • Use Treat.Me in a way that damages Treat.Me, users, merchants, payment processors, or third parties.

15. Content, Reviews, and Feedback

15.1 User Content

You may submit profile photos, bios, messages, reviews, ratings, reports, support requests, and other content. You are responsible for your content.

15.2 License to Treat.Me

You grant Treat.Me a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, publish, transmit, and use your content as needed to operate, improve, protect, promote, and provide the Service.

15.3 Content Moderation

Treat.Me may remove, restrict, edit, hide, or preserve content if we believe it violates these Terms, may cause harm, may expose Treat.Me to liability, or may be required for safety, legal, or operational reasons.

15.4 Reviews and Ratings

Reviews and ratings must be truthful, relevant, and based on actual experiences. You may not manipulate reviews, post fake reviews, retaliate through reviews, or offer compensation for reviews.

15.5 Feedback

If you provide feedback, ideas, suggestions, or improvements, Treat.Me may use them without restriction or compensation to you.

16. Privacy

Treat.Me’s collection, use, disclosure, retention, and protection of personal information are described in the Treat.Me Privacy Policy. By using the Service, you acknowledge the Privacy Policy.

Treat.Me may process data relating to account activity, location, event coordination, payment status, verification, merchant handoff, safety reports, support requests, device sessions, push notifications, and fraud prevention as described in the Privacy Policy.

17. Safety and Reporting

17.1 Safety Guidelines

You agree to follow Treat.Me’s User Guidelines and Safety Tips. Safety guidance may be updated from time to time.

17.2 Reporting

You may report unsafe conduct, suspicious activity, harassment, payment requests, scams, merchant issues, verification problems, no-shows, or policy violations through the Service or by contacting support.

17.3 Review of Reports

Treat.Me may review reports, event records, communications, payment records, location-related signals, verification records, merchant information, and other available data. Treat.Me may take action based on incomplete information where necessary to protect users or the Service.

17.4 Emergency Situations

If you are in immediate danger, contact local emergency services first. Treat.Me support is not a substitute for police, medical, fire, or emergency response services.

18. Third-Party Services

18.1 Payment Processors

Payment processing may be provided by Stripe or other payment processors. Their terms and privacy practices may apply to payment-related activity.

18.2 Maps, Location, Communications, and Infrastructure

Treat.Me may use third-party providers for maps, location services, hosting, analytics, push notifications, email, SMS, security, bot protection, customer support, and infrastructure.

18.3 App Stores

If you download Treat.Me through Apple App Store, Google Play, or another app marketplace, that marketplace’s terms may also apply.

19. Intellectual Property

19.1 Treat.Me Property

The Service, software, designs, interfaces, logos, trademarks, trade names, text, graphics, icons, images, databases, code, and other materials are owned by Treat.Me or its licensors and are protected by intellectual property laws.

19.2 Limited License

Treat.Me grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, lawful purposes in accordance with these Terms.

19.3 Restrictions

You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, create derivative works from, or exploit any part of the Service except as permitted by law or expressly authorized by Treat.Me.

19.4 Open-Source and Third-Party Materials

The Service may include or display open-source software, third-party libraries, trademarks, payment logos, app store badges, maps, fonts, images, or other third-party assets. Those materials remain subject to their respective licenses and ownership rights.

20. Availability, Changes, and Beta Features

20.1 Service Availability

Treat.Me may be unavailable, delayed, interrupted, inaccurate, or limited due to maintenance, outages, third-party failures, merchant issues, payment processor issues, network conditions, location service limitations, or events beyond our control.

20.2 Service Changes

Treat.Me may modify, suspend, discontinue, restrict, or replace any feature, event type, merchant tool, payment flow, fee structure, verification step, safety feature, or eligibility requirement at any time.

20.3 Beta and Experimental Features

Treat.Me may offer beta, pilot, experimental, or limited-release features. Such features may be unstable, changed without notice, or removed at any time.

21. Account Suspension and Termination

21.1 Termination by You

You may stop using the Service or request account deletion, subject to any outstanding payments, disputes, events, investigations, legal obligations, or retention requirements.

21.2 Suspension or Termination by Treat.Me

Treat.Me may suspend, restrict, or terminate your account if we believe you violated these Terms, created risk, caused harm, engaged in suspicious activity, failed payment obligations, abused cancellation or refund processes, or used the Service unlawfully.

21.3 Effect of Termination

Termination does not eliminate obligations that arose before termination, including payment obligations, cancellation fees, dispute obligations, indemnity obligations, intellectual property restrictions, and other provisions intended to survive.

21.4 No Refund for Termination for Cause

If Treat.Me suspends or terminates your account for violation of these Terms, you may not be entitled to refunds, credits, or compensation, except where required by law.

22. Disclaimers

22.1 Service Provided “As Is”

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Treat.Me disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and safety.

22.2 No Guarantee of Users or Merchants

Treat.Me does not guarantee user identity, user conduct, merchant quality, merchant availability, merchant compliance, event success, food quality, menu accuracy, payment processor availability, location accuracy, verification success, or personal safety.

22.3 No Background Checks

Treat.Me does not guarantee that it conducts background checks on users. Even if Treat.Me performs checks or screening in some cases, those checks may be limited, incomplete, delayed, inaccurate, or not updated.

22.4 Location and ETA Accuracy

Location, ETA, proximity, and map information may be approximate, delayed, unavailable, or inaccurate. You should not rely exclusively on Treat.Me for navigation, safety, or emergency decisions.

22.5 Food and Allergy Disclaimer

Treat.Me is not responsible for food preparation, ingredients, allergens, cross-contamination, nutrition information, merchant handling, or dietary representations. You are responsible for confirming allergen and dietary information directly with the merchant.

23. Limitation of Liability

To the fullest extent permitted by law, Treat.Me and its affiliates, officers, directors, employees, contractors, licensors, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including lost profits, lost data, personal injury, emotional distress, business interruption, loss of goodwill, or loss of opportunity.

To the fullest extent permitted by law, Treat.Me’s total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid directly to Treat.Me in service fees during the twelve (12) months before the event giving rise to the claim; or (b) the minimum amount required by applicable law.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.

24. Indemnification

You agree to defend, indemnify, and hold harmless Treat.Me and its affiliates, officers, directors, employees, contractors, licensors, service providers, and agents from and against any claims, demands, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • Your use or misuse of the Service.
  • Your violation of these Terms.
  • Your violation of law or third-party rights.
  • Your content.
  • Your conduct toward another user, merchant, staff member, Treat.Me representative, or third party.
  • Your payment disputes, chargebacks, fraud, cancellation abuse, no-show, verification failure, or off-platform conduct.

Treat.Me reserves the right to control the defense of any matter subject to indemnification, and you agree to cooperate with our defense.

25. Dispute Resolution

25.1 Contact Support First

Before filing a legal claim, you agree to contact Treat.Me support and attempt to resolve the dispute informally, unless prohibited by law or inapplicable to the type of claim.

25.2 Governing Law

These Terms are governed by the laws of [Insert Governing State/Country], without regard to conflict-of-law rules, except where applicable law requires otherwise.

25.3 Venue

Unless another dispute resolution process applies or is required by law, claims arising out of or relating to these Terms or the Service must be brought in the state or federal courts located in [Insert County, State/Country], and you consent to personal jurisdiction and venue in those courts.

Treat.Me may update these Terms from time to time. If we make material changes, we may notify you by email, in-app notice, website notice, or other reasonable means.

The updated Terms become effective on the date stated in the updated Terms. Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service.

27. Miscellaneous

27.1 Entire Agreement

These Terms, together with the Privacy Policy, User Guidelines and Safety Tips, and any additional policies or terms referenced in the Service, form the entire agreement between you and Treat.Me regarding the Service.

27.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable where permitted by law.

27.3 No Waiver

Treat.Me’s failure to enforce any provision is not a waiver of its right to enforce that provision later.

27.4 Assignment

You may not assign or transfer these Terms without Treat.Me’s prior written consent. Treat.Me may assign or transfer these Terms as part of a merger, acquisition, financing, corporate reorganization, sale of assets, or by operation of law.

27.5 Force Majeure

Treat.Me is not liable for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, internet outages, payment processor outages, merchant closures, labor disputes, government actions, emergencies, war, terrorism, civil unrest, pandemics, technical failures, or third-party service failures.

27.6 Headings

Headings are for convenience only and do not affect interpretation.

27.7 Survival

Sections relating to payments, fees, cancellation, refunds, content licenses, intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, enforcement, and any obligations intended to survive will survive termination.
